Terms and Conditions


For the purposes of this document, *Little One Photography* shall be referred to as "LOP." The visitor to the site or the individual (whether representing an organization or not) who orders an image shall be referred to as the "Client."


Applicable Law

a) This agreement shall be governed by the laws of England and Wales. These Terms and Conditions cannot be altered except by a written agreement.

b) In the event of any conflict between these Terms and Conditions (including those related to payment timelines) and any terms issued or submitted by the Client, these Terms and Conditions shall prevail unless agreed otherwise in writing.


Booking Fee

a) By booking with LOP, you enter into a contract and agree to abide by these Terms and Conditions.

b) Booking fees for newborn or portrait sessions are non-refundable, except in cases where LOP cancels the booking.


Images Online

a) It is illegal to download or remove watermarks from any image posted online by LOP. Unauthorized saving, use, or reproduction of these images without written permission from LOP will result in a copyright infringement fee of £1000 per image. This fee must be paid within 28 days to avoid court action.


Fulfillment of Obligations

a) LOP shall not be liable for any failure, in whole or in part, to fulfill its obligations due to events or circumstances beyond its control, including but not limited to equipment failure, inclement weather, illness, or injury.

b) The Client understands and accepts that photographic coverage will be determined by LOP’s professional expertise. While every effort is made to accommodate special requests, these are not binding instructions.

c) In the unlikely event of total photographic failure, cancellation of the contract by either party, or other circumstances, liability shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential losses.


Prints

a) All prices are subject to change without notice by LOP. Previous clients are not entitled to consideration regarding product pricing, availability, package structure, or session fees.


Previews/Proofs

a) While LOP will strive to produce more proofs than discussed with the Client, there is no guarantee of a specific number of proofs.


Image Production and Handling

a) LOP will use its professional judgment regarding the style and artistic input in producing images, including locations, poses, and the number of images taken. Due to factors such as weather or the willingness of subjects, it may not be possible to capture all requested images or meet all client expectations. The Client is responsible for managing all children during sessions.

b) LOP fully edits all images before presenting them to the Client. Additional edits are at LOP’s discretion, and LOP reserves the right to charge £15 per image for extra editing requests. Any additional edit requests must be raised during the proofing stage. Requests made after products are ordered will not be considered.

c) If the Client does not view or purchase images within three months of the session without prior arrangement, LOP will assume the images are not wanted and may delete all files.


Copyright & Reproduction

a) Copyright remains with LOP at all times worldwide. No image may be copied, scanned, or reproduced in any form without LOP's prior consent, including saving or downloading from social media.

b) The Client may not alter, add to, or manipulate an image by any means without LOP’s written permission.

c) Permission to reproduce an image is granted to the Client only when a reproduction fee has been agreed upon, an invoice issued by LOP, and payment received in full.

d) Unauthorized reproduction will result in a liquidated damages fee of £1000 per image, or double the standard reproduction fee, whichever is greater.

e) The right to reproduce an image is personal to the Client and may not be assigned to any third party without LOP’s prior written consent.

f) The Client will fully indemnify LOP against any unauthorized reproduction by third parties arising from a breach of these terms by the Client.


Identification

LOP has taken reasonable care to correctly identify, caption, and orientate the pictures, but does not accept liability for any loss or damage caused by errors.


Receipt of Pictures

Pictures are presumed to have been received in good condition unless the Client notifies LOP in writing of any discrepancy or error within 14 days of receipt.


Cooling Off Period

a) The Client has a 14-day cooling-off period from the date LOP acknowledges receipt of the booking fee, during which they may cancel the session.

b) Due to the bespoke nature of photography, the Client does not have the right to a cooling-off period, refund, or exchange on products of any kind (including digital products) once an order has been placed.

c) By placing an order with LOP, you commit to purchasing the ordered products.


Returns Policy

a) Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge.

b) Returns will not be considered for incorrectly ordered items or items ordered in error.

c) No return, exchange, or refund is available on any item once the image proof has been approved and an order placed.


Use of Pictures

LOP retains the right to use any images for sales, advertising, or promotional purposes at any time worldwide.


Severability

If any provision of this agreement is held to be invalid or unenforceable, the validity of the agreement as a whole shall not be affected, and the remaining provisions shall remain in full force and effect.


Camera Policy

Cameras, camera phones, camcorders, or any other recording equipment are not permitted during any session, either in the studio or on location, without the express permission of LOP.


Privacy Policy

LOP will never share or distribute any personal or contact information of any client or inquiry. All contact information is securely stored and password-protected at all times.


Gift Vouchers

a) Gift vouchers purchased from LOP are valid for 12 months from the date of purchase.

b) Gift vouchers cannot be exchanged for cash, are non-transferable, and no refunds will be given.


Online Galleries

Online galleries will be live for 7 days, as agreed with the Client. All orders must be placed within this timeframe.


COVID-19

a) All bookings made from 24th March onwards are subject to government guidelines regarding COVID-19. If your session cannot proceed, it will be rescheduled for an age-appropriate session of equal value as soon as it is safe to do so.

b) While every precaution is taken to minimize risk, the Client accepts that LOP will not be held responsible for any COVID-19 infection following any session.
